META and YOUTUBE condemned: is Silicon Valley entering its tobacco moment?

In the Los Angeles courtroom, after nine days of deliberation, the jury will have ruled in favor of a 20-year-old plaintiff and recognized Meta Platforms and Google as responsible, not for the content distributed on their platforms, but for the way in which they were designed.

A reasoning which is not trivial, because it concerns neither moderation nor the circulation of problematic content, but focuses on the very architecture of the products: notifications, infinite scrolling, automatic reading, interaction mechanisms. In other words, at the heart of platform design.

This change of point of view undoubtedly constitutes the most structuring element of this highly anticipated decision because it could usher the platforms into a new era. It introduces a legal hypothesis which, until now, remained marginal: that of a responsibility linked not to what the platforms host, but to the way in which they capture and direct attention.

A responsibility that is redefining itself

For more than two decades, the major platforms have built their model on the thesis that they were not responsible for the content published by their users. This framework, consolidated in particular in the United States, has enabled the emergence of very large-scale services such as Facebook, Snap, TikTok, by limiting their legal exposure.

The Los Angeles trial follows a different logic, where the plaintiffs do not contest the presence of specific content, but question the mechanisms that structure the user experience. The central argument can be boiled down to the fact that certain features are not neutral. They would be designed to maximize engagement, by mobilizing known cognitive and behavioral resources: intermittent gratification, anticipation of reward, repetition.

From digital product to risky product

In this context, platforms are no longer seen only as technical intermediaries, but as designers of experiences likely to produce harmful effects.

The parallel with other industries is not formulated in a legal way, but it runs through the arguments and is reminiscent of our editorial published last year “What if we regulated social networks like we regulated tobacco?”. As with tobacco or opioids, the question posed is not only that of use, but that of the design of the product.

The notion of “addiction by design” does not necessarily assume that all users develop dependence, but that a product can, under certain conditions, encourage compulsive behavior, particularly among vulnerable groups.

The jury retained the idea that companies should have anticipated these effects and, at a minimum, warned the youngest users.

Limited amounts, an expanded signal

The damages awarded, a few million dollars, remain modest compared to the capitalization of the groups concerned. They combine a compensatory part and a punitive part, intended to sanction and deter.

Especially since this first verdict comes in a context of multiplication of procedures: individual actions, collective complaints, appeals by public authorities, initiatives by educational establishments. Several so-called “test” cases are to be judged in the coming months and if the decisions converge, they could encourage companies to consider global agreements, as has been the case in other sectors facing mass litigation.

Without prejudging the outcome, the prospect of significant financial exposure is emerging.

A causality difficult to establish, but circumvented

One of the most debated points during the trial concerns causation. Can we attribute psychological disorders to the use of a platform, when multiple factors (family, social, school) are involved?

The respondents insisted on this complexity, emphasizing the absence of a formal diagnosis of addiction and the existence of positive uses of the services concerned.

The jury did not ignore these elements, but it did not consider them decisive, and its decision suggests that an exhaustive scientific demonstration is not essential. A body of evidence, associated with a coherent interpretation of the mechanisms at play, may be sufficient to establish responsibility. This approach, if confirmed, lowers the threshold of proof required and could facilitate other actions.

Towards design regulation

Beyond the specific case, the question that emerges is that of the regulation of interfaces.

If certain features are considered problematic, several options emerge:

    • limitation or supervision of certain practices (infinite scrolling, autoplay)
    • reinforced information obligations
    • differentiation of experiences for minors
    • establishment of design standards

Such a development would bring platforms closer to other industries subject to strict technical standards, where product safety is regulated upstream.

It would also pose a direct challenge to economic models based on engagement. Reducing the time spent or frequency of interaction can have a measurable impact on advertising revenue.

An economic model under pressure

The attention economy is based on a simple equation: capture, retain, monetize. Key indicators (time spent, connection frequency, interactions) structure both product decisions and company valuation.

The ongoing litigation introduces a new tension, because the mechanisms that optimize the growth of social platforms could become sources of legal risk.

A pivotal moment, with no written outcome

Comparing the current situation to that of tobacco can shed light on certain dynamics, but future decisions remain uncertain. Digital uses are deeply integrated into social and professional practices, and their usefulness is hardly debated. The question is therefore not that of a ban, but of an adjustment. How far will platforms have to modify their products? At what pace? Under what legal or regulatory pressure?

The Los Angeles verdict is not an isolated case. A few days earlier, a civil jury in Santa Fe, New Mexico, also found Meta Platforms liable for exposing minor users to risk on its platforms. The group was ordered to pay $375 million in damages, a significant amount, although less than the nearly two billion dollars initially demanded by prosecutor Raul Torrez.

Taken together, these two decisions mark a progressive shift in the legal understanding of the role of social platforms, in particular with regard to younger audiences. They suggest that the question of responsibility is no longer limited to content, but now extends to conditions of use and engagement mechanisms.

The next decisions will be closely scrutinized, both by defense associations and by investors, for whom the evolution of the legal framework could ultimately affect the economic model of the platforms and, by extension, their performance.
