Executives on the days package benefit from a calculation of their working hours in days, and not in hours like other employees. Explanations.
What is a days package?
A day pass is a system ofarrangement of working timewhich is materialized by a flat rate agreement in days over the year.
It is about define the duration of an employee’s work in a number of days worked over the yearand no longer in hours. In other words, a part of the day package must work a specific number of days out of the year. All notion of hours is abandoned.
Who can benefit from a days package agreement?
The days package over the year does not benefit all employees. Only two categories may be concerned, subject to their agreement:
-
THE executives whose nature of functions does not lead them not following the collective schedule applicable within the workshop, department or team in which they are integrated;
-
employees who have a real autonomy in organizing their time.
How to set up the day pass?
The possibility of concluding a package agreement in days must be provided for by a collective agreement applicable in the company (company or establishment agreement or, failing that, branch collective agreement).
The day package must then be subject to:
-
of theemployee agreement ;
-
and a individual package agreementestablished in writing.
How long does an executive work on a days package?
The day package framework has a working time defined in days over the year.
The number of days included in the package is defined in the individual package agreement, within the limit of the duration provided for by the collective agreement (this number of days cannot be greater than 218 days/year ).
The day package framework is not subject to the maximum daily and weekly working hours, nor to the legal working hours. He does not benefit from the overtime regime.
However, it remains subject to the rules relating to daily rest (11 a.m.), weekly (35 consecutive hours), public holidaysand to paid leave .
The number of days worked may be greater if additional days of rest are given up.
Additional days of rest (JRS) or RTT: what are the manager’s rights to the days package?
Each year, the difference between the working days provided for in the package and the non-working days (Saturdays, Sundays, paid holidays, non-working public holidays falling on a working day), makes it possible to determine the number of additional days of rest (JRS)from which the framework benefits.
Attention, it is not about RTT.
